Abstract
Legislation's on registration of marriage provide mechanism, which represents a societal commitment to equality, diversity and non-discrimination, thereby benefiting women's lives.However, often vague provisions on the marriage laws and weak practices can be the hurdle towards the upholding of the rights of ‘unregistered wife’ as evident in this paper.This paper focuses on the legal position of the ‘unregistered wife’ in the unique multi-religious and multi-racial society in Malaysia. Selected jurisdictions are used as comparative study and the paper emphasized the importance of registration of marriage and urge for the re-enforcement of registration of marriage via unambiguous provisions of the laws and strategic practices.
