Abstract

This research aims to analyze the constitutionality of legislative general elections by reviewing the closed proportional system in the 1945 Constitution. The legislative general election system is an important aspect in maintaining democratic principles and fair representation in a country. The closed proportional system has been the subject of ongoing debate regarding its constitutionality in the context of the 1945 Constitution. This research uses a qualitative approach with normative juridical methods to analyze the constitutionality of legislative elections using a closed proportional system. This approach involves collecting data from legal documents, literature studies, and court decisions relevant to the topic. The research results show that the application of a closed proportional system in legislative elections has several constitutional implications. First, this system can limit political access for individuals outside political parties, which could be considered a violation of individuals' constitutional rights to participate in the political process. This research also analyzes the implications of implementing an open proportional system in legislative elections. This research also shows that a closed proportional system can provide greater political stability and strengthen the role of political parties in the political system
