Abstract
The issue of personal data leaks, especially electronic medical record data is no longer just a national problem but has become a global problem around the world. Electronic medical record data contains information about the patient's medical history, rights and obligations content. Different countries have different legal avenues in dealing with this issue. This study discusses the issue of legal certainty in resolving cases of electronic medical records data leaks in Indonesia and the United States and the impact arising from the problem of electronic medical record data leaks that do not yet have legal certainty. The results obtained, that this problem has an impact on patients and the institution or organization that manages electronic medical record data in the form of personal, social, economic and government impacts. Therefore, in this case, a clear legal certainty is needed regarding the protection of electronic medical record data, especially in the health industry
